What if the other party does not honour CCMA or Bargaining Council award?
If an award is issued in favour of one party and the other party does not comply with the order, the party in whose favour the award is granted can apply to the CCMA for certification of the award (using the LRA 7.18 form, or the LRA 7.18A form in respect of a Bargaining Council award). If the award is for the payment of an amount of money the certified award can then be handed directly to the Sheriff of the Court for attachment of goods belonging to the defaulting party.
An award which orders something other than the payment of an amount of money (for example reinstatement or re-employment, the certified award can be enforced through contempt of court proceedings in the Labour Court.
