Question: Is it possible to challenge a past designation made by the ESC?
Yes. Section 71(9) of the LRA provides that the Committee may vary or cancel the designation of the whole or a part of a service as an essential service. The process for doing so is provided for in subsection 71(1) to 71(8) of the LRA.
